  • Bijlage 2 10-Stappenplan Wwft 2023
  • Bijlage 3 specifieke leidraad
  • Bijlagen Specifieke Leidraden 2024
  • Notitie crypto’s
  • Praktijkvoorbeelden zorgfraude
  • Praktijkvoorbeelden UBO’s
  • Praktijkvoorbeelden ongebruikelijke transacties notariaat en registergoederenpraktijk
  • Praktijkvoorbeelden ongebruikelijke transacties

Regelgeving

We, the Home Affairs, Interior, Security and Immigration Ministers of Australia, Canada, New Zealand, the United Kingdom, and the United States (the ‘Five Countries’) remain steadfast in our commitment to uphold and promote shared liberal democratic values, and in working collaboratively to protect our citizens, communities, and governments from evolving national security threats in an increasingly contested world.

AML Package: “the reform was of a massive size, and there are important novelties” | the European anti-money laundering lawyers’ paradise

If you ask Dutch bankers or anti-money laundering university professors whether much will change because of the AML Package, the answer you will get is that little will change and that it is only codification/harmonisation of already known rules.

Anyone who reads the new European regulation and directives can see that those claims are not true.

My observation is confirmed by the statements of the Commissioner-designate who will be responsible for the Package.
Ms Maria Luis Albuquerque, candidate for the Financial Services and the Savings and Investments Union portfolio, said in response to questions from members of a European Parliament committee:

We have until mid-2027 to prepare the ground for the application of the new framework. We therefore have no time to lose; the reform was of a massive size, and there are important novelties that we must ensure are introduced in a coherent manner. Work needs to start now if we are to deliver.

It is worrying that very sweeping legislation is being introduced in the EU without citizens, civil society organisations, national parliaments and many others having had a chance to look at it properly. After all, these are rules that will affect every citizen and every SME.

I find it bizarre.

The complete text of question & answer 9

(source: Written questions and answers by Ms Maria Luis Albuquerque):

Question from the Committee on Civil Liberties, Justice and Home Affairs

9. Your mission will be to continue working on digital finance, as well as on the implementation of the new antimoney laundering package.

What steps do you envisage to take in order to assess the deployment of AI systems in the financial sector, including their compliance with the specific requirements for high-risk AI systems provided for in the AI Act (such as risk management systems or fundamental rights impact assessments)? Which priority steps do you intend to take in order to effectively implement the new AML single rulebook, in particular with regard to financial sector, but also non-financial sector as well as new powers, competences and tools provided to the Financial intelligence units in order to prevent, detect and combat money-laundering and terrorist financing?

In my mission letter, President von der Leyen has asked me to continue work on digital finance and in particular to assess the deployment of artificial intelligence (AI) in finance. If I am confirmed as Commissioner, I will work with other members of the College, and with the support of DG FISMA , the European Supervisory Authorities (ESAs) and the newly established AI Office of the European Commission, to achieve our common goals. I will of course also work closely with the European Parliament and the Council. I will, if confirmed, build on the work already done, notably recent consultations and targeted outreach aimed at seeking to gather insights from stakeholders on the current market developments as well as potential risks and barriers impeding AI uptake in the financial sector. I will also work closely with the supervisory community and the AI Office to ensure compliance with the specific requirements for high-risk AI systems outlined in the AI Act. Finally, because AI very much presents opportunities and risks at a global level, I will, if confirmed as Commissioner, work with our international counterparts such as the Financial Stability Board, the Financial Action Task Force, the Basel Committee on Banking Supervision and the Bank for International Settlements to develop globally co-ordinated solutions, respecting European values.

I believe it is of utmost importance to work with all stakeholders – be it consumers, users, providers, developers, or supervisors, and not least the European Parliament and the Council – to ensure a swift implementation of the new rules under the AI Act. The AI Act identifies consumer credit assessment and risk assessments and pricing in health and life insurance as high-risk applications, and we need to devote particular attention to the fact that AI use in these sectors meets the standards set in the AI Act. If confirmed, I will work closely with the Vice-President for Tech Sovereignty, Security and Democracy to assess the AI deployment in the financial sector. If questions arise in relation to EU financial sector legislation in terms of how it applies to AI, I will also work closely with the supervisory community to see how best to address these issues.

If confirmed, I would like to take a proactive approach to addressing the evolving landscape of AI in finance, recognising the need for a nuanced policy approach that balances innovation, seizes the opportunities and advantages it may offer with solid risk management, be it from a financial stability or fundamental rights perspective. By engaging with the co-legislators, stakeholders and fostering dialogue, I would like to create a supportive ecosystem that enables both the financial sector and financial supervisory community to harness the potential of AI while mitigating its risks.

On anti-money laundering, the package of reforms agreed under the previous mandate has the potential to bring true change in the fight against financial crime. But laws are only as good as their implementation on the ground. I fully share the goal set out in the political guidelines for this Commission to focus on better implementation and enforcement of Union rules. I believe that this should be our primary focus in the anti-money laundering field if we are to make this reform a reality and a success. If confirmed, I will closely align with the Commissioner-designate for Internal Affairs and Migration to ensure consistent approaches to our common goals of fighting organised crime. I will also ensure close cooperation between the Commission and Member States for the correct transposition of the new Anti-Money Laundering Directive, as well as open dialogue with the sectors to enable the smooth phasing-in of the requirements of the new Anti-Money Laundering Regulations.

We have until mid-2027 to prepare the ground for the application of the new framework. We therefore have no time to lose; the reform was of a massive size, and there are important novelties that we must ensure are introduced in a coherent manner. Work needs to start now if we are to deliver.

Work on implementing and delegated measures is already underway. They will set out in detail how entities in the financial and non-financial sector alike are expected to comply with important requirements. Work on the common tools and methodologies for supervising these sectors is also being prioritised. If I am confirmed as Commissioner, I will ensure that my services continue building on this momentum, through close cooperation with the European Banking Authority and national authorities. All the technical measures will be publicly consulted so that the industry can provide insights and suggestions. This process will ensure that the regulatory requirements are adequate, proportionate, and fit for purpose. Equally important for me will be the right set-up of the Anti-Money Laundering Authority.

With respect to Financial Intelligence Units (FIUs), work to harmonise how Financial Intelligence Units receive, process and exchange information has already started. Furthermore, in close cooperation with Financial Intelligence Units, the Commission is currently developing a new version of the ‘FIU.net’ secure information exchange platform. Work has also been launched for the interconnection of the national bank account registers. All those workstreams will significantly enhance the Financial Intelligence Units’ ability to swiftly exchange and analyse information and report cases to law enforcement authorities.

Looking forward, if I am confirmed as Commissioner, I will not shy away from acting decisively. Europe cannot afford to repeat the same mistakes of the past where late or incorrect measures adopted or implemented at national level jeopardised our collective ability to fight financial crime. Therefore, I intend to use all instruments for implementation and enforcement at my disposal, including prevention and infringement proceedings, to ensure the framework and our authorities deliver on our commonly agreed goals.

Addition 26 November 2024
Look at the political guidelines for the new Commission and the article on eucrim on these guidelines. There is a lot of ‘security’ in it, that includes the AML Package, with a lot of optimism, like (from the article) “Fighting organised crime and dismantling high-risk criminal networks and their ringleaders” and access to confidential information: “Providing law enforcement with adequate and up-to-date tools for lawful access to digital information, while safeguarding fundamental rights” (= breaking encryption). The public authorities are entitled to sucure communication: “Developing a new European Critical Communication System to be used by public authorities in charge of security and safety“, while citizens have to cope with insecure e-mail and messaging that can be read along by the authorities.

Standpunt Privacy First

Citizenship-based taxation / FATCA

Beperking contante betalingen vanaf 3000 euro

Real-time data reporting for VAT-purposes

In the ‘VAT in the digital age package‘ that the Council of the EU has reached agreement on (announcement) real-time data reporting is an important element:

With new rules on electronic invoices and real-time data reporting, as well as business carried out through digital platforms, this package of legislation will fight tax fraud, support businesses and promote digitalisation

It illustrates the move towards real-time data provision to governments, which I wrote about.

E-invoicing of B2B cross-border transactions & automated reporting
According to the new rules the VAT reporting obligations for cross-border transactions will become fully digital by 2030:

Businesses will issue e-invoices for cross-border business-to-business transactions and automatically report the data to their tax administration. This will be based on the existing European standard for e-invoicing in the area of public procurement. National tax administrations will then share the data through a new IT system that will be capable of providing analyses of suspicious activities.
A framework at national level will ensure the quality of the data included in electronic invoices, with flexibility for member states in the operationalisation of that framework.
This will provide member states with quick and complete information on cross-border transactions that they can use to fight VAT fraud.

It can be assumed that member states will extend the obligation to provide real-time transaction information to all domestic B2B-transactions [*].
An interesting side effect of these disclosures is that national and European governments gain insight into all B2B cross-border transactions carried out in the EU (and broader when domestic transactions are included). With this information, much more can be done than just fighting VAT fraud.

VAT on short-term accommodation and passenger transport services
Another element of the package is that online platforms will be required to pay VAT on short-term accommodation and passenger transport services in most cases where individual service providers do not charge VAT.

[*] For example, when implementing Directive (EU) 2023/2226, the Netherlands decided that domestic cryptocurrency transactions must also be reported real-time to the tax authorities (article).

Microdata for European statistics

The Council of the EU on 5 November announced it has adopted changes to the EU legal framework on the development, production and dissemination of European statistics:

The revised regulation lays the foundations to make European statistics fit for the future by ensuring a sustained access to data held by businesses and public administrations for statistical purposes. It will allow the European Statistical System to tap the potential of digital data sources and technologies to satisfy increasing demands for new, more granular and timelier statistics and to be more responsive while at the same time reducing the reporting burden.

According to the Council Conclusions the European Statistical System (ESS) promotes literacy and ensures:

the availability of high quality and relevant statistics that will help to tackle disinformation and contribute to fact checking and the protection of democracy

New data sources, including privately held data

The amended regulation is found here. In the preamble of the regulation it is explained that new data sources will be added, including privately held data [1]:

(9) Accessing and using new data sources, including big data, which emerge from digital services and the Internet of Things (IoT), is becoming vital for producing timely, suitably frequent and sufficiently detailed European statistics in a more efficient and less costly way. Such new data sources also constitute an important contribution to building statistical sampling frames for ESS purposes. Therefore, access to new data sources in general, and in particular to privately held data, for the development and production of European official statistics on a sustainable basis and according to fair, clear, predictable and proportionate rules, in line with the Union’s fundamental rights framework, should be ensured. Access to privately held data should be ensured in conformity with the principle of cost-effectiveness and is not to entail excessive burdens on economic operators as laid down in Article 338(2) of the Treaty on the Functioning of the European Union (TFEU).

(10) Privately held data refers to the vast amount of data held by private entities obtained as a result of their activity, which could be used by statistical authorities to produce official statistics. It might include data held by civil society organisations, among others. Such data can be key to complementing official statistics and monitoring economic, social, and environmental progress and in particular progress related to the Sustainable Development Goals of the United Nations. The use of such data should therefore be strongly encouraged.

According to the regulation national authorities also have to provide data [2]. This may e.g. include the tax data held by tax authorities.

Personal data for European statistics

When private entities and national authorities have to share their data, personal data will be included:

(21) Where the activities to be carried out under Regulation (EC) No 223/2009 involve the processing of personal data for official statistical purposes in accordance with the mandate given to the statistical authorities to request personal data pursuant to the specific methodological description for each statistical product, such processing should comply with relevant Union law on personal data protection, namely Regulations (EU) 2016/679 and (EU) 2018/1725. In accordance with the principles set out in those Regulations, such processing should be subject to appropriate safeguards for the rights and freedoms of the data subject. Those safeguards should ensure that technical and organisational measures are in place, in particular in order to ensure respect for the principle of data minimisation. Those measures might include pseudonymisation.

In theory there are safeguards:

(22) Processing of personal data for the purposes of official statistics by NSIs and other national authorities, which is considered to be in the public interest, should be covered by derogations and subject to appropriate safeguards, in accordance with Regulation (EU) 2016/679. For instance, further processing of personal data for statistical purposes should not be considered to be incompatible with the initial purposes for which they were collected. Personal data processed for statistical purposes in the public interest are confidential data and thus are subject to the statistical confidentiality principle, which means that they should only be used for statistical purposes and should never be used for supporting measures or decisions regarding any particular natural person. In that context, the particular safeguards, which should be applied when data sharing under Regulation (EC) No 223/2009 requires personal data to be processed, include technical and organisational measures such as privacy-enhancing technologies and the respect of the principles of purpose limitation, data minimisation, storage limitation and integrity and confidentiality as set out in Regulation (EU) 2016/679 and Regulation (EU) 2018/1725 and further elaborated in the European Statistics Code of Practice. In that regard, privacy-enhancing technologies that are specifically designed to implement those principles should be used to share data. Pursuant to Article 89(2) of Regulation (EU) 2016/679, derogations should be granted by national law to the development, production and dissemination of European statistics by NSIs and other national authorities, under the safeguards laid down therein.

The European Data Protection Supervisor was consulted and delivered an opinion on 6 September 2023.

The EU’s opaque microdata landscape

The documents do not reveal which microdata European institutions already have, which new public data will be added and which private parties will be asked for data. It can be assumed that financial institutions are already an important provider of microdata.
It is disappointing that the EU’s current microdata landscape is not described and, as a result, the public is unaware of what data about them is already being processed.

Notes:

[1] See “Article 17b Obligation of private data holders to make data available for developing, producing and disseminating European statistics
1. Without prejudice to reporting obligations, data collections or any data access laid down in sectoral statistical legislation of the Union or to the obligation for data holders to make data available on the basis of an exceptional need in accordance with Regulation (EU) 2023/2854 of the European Parliament and the Council* , an NSI or the Commission (Eurostat) may request a private data holder to make data and the relevant metadata available free of charge where the data requested are strictly necessary for the development, production and dissemination of European statistics and cannot be obtained by other means or their reuse will result in a considerable reduction in the response burden on data holders and other businesses. Such data collections or data access may be included by the Commission in the annual work programme. (…)
6. This Article shall not apply to microenterprises or small enterprises as defined in Article 2 of the Annex to Commission Recommendation 2003/361/EC****, except in duly justified cases where the data held by such microenterprises or small enterprises are of specific interest for official statistics because of the nature and volume of those data at national level.
“.

[2] Article 17a: “1. National public and semi-public bodies under national law in charge of administrative data sources, databases, interoperability systems or data relevant and necessary for the development, production and dissemination of European statistics shall allow the NSIs and other national authorities to access, use and integrate, free of charge, those data and the relevant metadata, in a timely manner and with sufficient frequency and granularity for the purpose of developing, producing and disseminating European statistics. (…)“.

The Transparent Individual in the OECD Tax Co-operation for the 21st Century

The OECD is working on a project that is called ‘Tax Co-operation for the 21st Century‘ and is regularly reporting to the G7 Finance Ministers and Central Bank Governors on the progress.

The reports show that international governments, led by the U.S., want to make the most of digital opportunities. This latest report has a focus on the global minimum tax for businesses (‘GloBE Model Rules’), but also shows where taxation of ordinary citizens (‘taxation of individuals’) goes.

Real-time information through technology-based solutions
Already in the report published in 2022 it was observed that there is an increasing trend towards tax administration being based on real-time information [1]. The 2023-report refers to technology-based solutions for effectively collecting and using information for personal income tax purposes [2].
Chapter 2 of the latest report, ‘Beyond corporate tax‘, shows that in future organisations will provide governments with real-time information that allows the tax authority to prepare the draft tax returns, ‘third-party reporting’. Third-party reporting in the Netherlands already happens, by collecting information from banks, employers and other third parties, ‘renseignering’ [3].

See on real-time information e.g. paragraph 31.:

Chapter 2 of that Report looked at recent developments in relation to the exchange of information with respect to individuals. It also described the emerging trends, evolving from periodic, bulk, backward-looking access to information towards more targeted, direct, and real-time access to data.

The chapter refers to the Crypto-Asset Reporting Framework (CARF). In Europe based on this framework all cryptocurrency transactions will be real-time recorded in a European database [4]. It shows where it is going.

Large-scale exchange of beneficial ownership data
Though there are many ‘beneficial owners’ (BO’s) without any economic interest in their entity, the international legislator assumes that information about the BO is always relevant:

2.2.3. Beneficial ownership
36. While these developments will ensure that the tax transparency architecture for financial assets remains effective and fit for purpose, work has also started on possible approaches for enhancing tax transparency with respect to income held through non-financial assets, in particular real estate. In this connection, the report delivered by the OECD to the G20 Finance Ministers in July 2023 sets out possible structural solutions that step away from annual exchange of information between tax authorities and build on the trend of digitalising ownership registers to move to a model whereby tax authorities proceed with the real-time or fast sharing of information in data repositories, including real estate registers and beneficial owner registers of legal entities and legal arrangements.
37. In this respect, work is now advancing to collect information from jurisdictions on their current practices related to the collection and exchange of information on foreign-held real estate, which will be used to design a roadmap on how enhanced transparency on foreign-held real estate can be delivered by interested jurisdictions on an incremental basis. The combination of greater visibility on ownership of, and income derived from real estate, together with the advances in exchange on financial accounts and cryptoassets, provides opportunities for more effective and efficient taxation of income, as more information will be directly available to tax administrations, rather than pursuing an after-the-fact, time consuming audit or investigation in many cases.

The transparent individual
When this type of publication talks about ‘transparency’, such as ‘tax transparency’, it is about providing the best possible information to the government. It applies to everyone who has been given the qualification BO and to all other individuals. In fact, this means that every individual becomes transparent to the government with everything he or she does every second of the day.

In the future, real-time information flows will keep the government informed:

2.2.4. Real time information flows
38. The Forum on Tax Administration has also recognised the value of moving towards more real-time models of information flows. The integrated data vision explored in the OECD Forum on Tax Administration
3.0 report (OECD, 2020) is that by designing the data collection, reporting and exchange elements into the processes of taxpayers and businesses, with the data moving automatically through machine-to-machine based processes, including potentially in real-time, tax compliance can increasingly be designed in. Taking this forward, in October 2023, the FTA Plenary in Singapore approved a series of collaborative projects between tax administration and stakeholders from the business and academic communities to help progress the Tax Administration 3.0 vision. Two of these projects focus on the practical considerations raised by making data exchange between tax administrations or between tax administrations and business more automated and closer to taxable events. Two further projects are considering the strategic issues raised by digital transformation and how Artificial Intelligence can be used ethically by tax administrations.

Extra information sources
Currently international governments have realised large scale exchange of information on bank accounts (FATCA, CRS), accompanied by large scale exchange of information on individuals (account holders, BO’s [5]). In future new information sources will be added, like information on real estate [6] and on ownership of art objects [7].

Fundamental rights
What is striking about the report is that while fundamental rights are talked about, there is little to show in terms of protecting citizens from an overly greedy government [8]. An example of this is the US expecting everyone with US citizenship to declare world income in the US, even if the person lives outside the US and is already required to declare world income in the country of residence.

[5] Regulations on large-scale exchange of BO data are already partly functioning and will be further perfected.

[6] In paragraph 2.3. as potential areas of consideration for the future are mentioned: “Support the work to explore enhanced transparency on real estate and beneficial ownership.”

[7] Art and other assets are not mentioned in the latest report but are discussed in other OECD publications. Europe is already considering the mapping of every individual’s property through a central asset register, read the article of August 2021 and the article of September 2022.
