  1. het misbruik van rechtspersonen;
  2. toenemend risico bij derdenbetalingen;
  3. blijvend risico bij vastgoed;
  4. blijvend risico zorgfraude.

Hand in eigen boezem?

The databases of the AMLA

Anti-money laundering (AML) and countering terrorist financing (AML) in the EU is supposed to be a ‘data-driven’ [1]. It is therefore interesting to read the texts on information and communication technology in the Work Programme for 2025 of the European Authority for Anti-Money Laundering and Countering the Financing of Terrorism (AMLA).

EuReCA
Currently the European Banking Authority (EBA) is responsible for EuReCA, the black sheep database with financial institutions that do not comply with AML/CFT rules well enough. This database will be transferred to AMLA.

FIU.net system
The FIU.net system will be transferred to the AMLA (page 10):

These efforts will enable AMLA to begin joint analyses, facilitate mutual assistance, and progressively assume hosting of the FIU.net platform.

Central AML/CFT Database
AMLA is developing the Central AML/CFT Database, that is based on article 11 of the AMLA Regulation (‘AMLAR’). The database will be used by AMLA for analysing the collected information and for making available information to [2]:

  • supervisory authorities, non-AML/CFT authorities, other national authorities and bodies competent for ensuring compliance with a number of directives and a regulation;
  • the European Supervisory Authorities (the ESAs): EBA, ESMA and EIOPA.

The  database will be fed by supervisory authorities, non-AML/CFT authorities, other national authorities and bodies competent for ensuring compliance with a number of directives and a regulation. The database will include data related to individual obliged entities and related data subjects, including data on ‘fit and proper’ assessments of shareholders or members of the management body of individual obliged entities [3].

Personal data collected in the Central AML/CFT Database may be kept in an identifiable form for a period of up to ten years after the date of collection of the data by the AMLA, at the end of which those data shall be deleted. Based on a regular assessment of their necessity, personal data may be deleted before the expiry of that period on a case-by-case basis [4].

The AMLA will transplant concepts from the financial sector to the ‘non-financial’ sector | AML Package

The history of anti-money laundering is characterised by devising concepts that are supposedly suitable for financial institutions (FIs) (though they fail in complying [*]), which are then transferred to all kinds of companies doing completely different things.

The recently announced Work Programme for 2025 shows that the  Authority for Anti-Money Laundering and Countering the Financing of Terrorism (AMLA) will continue on this wrong path, even though they admit the other obliged entities are completely different, e.g. in (page 31):

In creating these mandates, the non-financial sector will be a special point of attention. The legal framework is currently significantly less harmonized in this sector compared with the financial sector.

The text “significantly less harmonized” is an understatement and shows that the AMLA neither knows nor understands the non-financial sector.

An example of the direction the AMLA is taking is found on page 47 (the annex):

An executive board member is cited with a text on a ‘unified’ framework:

“Our workstreams are defining building blocks for a unified, data-driven and resilient AML framework in Europe’s fight against financial crime.”

— Rikke-Louise Petersen, Executive Board Member, Policy Coordination

For the multitude of non-financial obliged entities, many of which are SMEs, things look bad. They are likely to go down with fines and other penalties for not complying properly with the “unified” AML rules

Note:

[*] Not because they don’t want to comply, but because the rules are unworkable.

The cryptocurrency sector has become a serious part of the financial sector according to the AMLA

Both national governments and European agencies are embracing the cryptocurrency sector, not only to make money from it (taxation), but also by designating them as gatekeepers, in the same way as banks. The question is whether the cryptocurrency sector is justified in being taken so seriously.

The Authority for Anti-Money Laundering and Countering the Financing of Terrorism (AMLA) published the press release ‘AMLA expects high standards against financial crime in crypto sector’ (also as pdf). From the release:

With the launch of its powers and responsibilities on 1 July 2025, AMLA expects firms engaging in crypto asset activities to have in place strong protections against money laundering and terrorist financing. (…)

AMLA recognizes that CASPs are exposed to significant money laundering and terrorist financing (ML/TF) risks due to their technological features, cross-border operations, and anonymity-enhancing capabilities. The Markets in Crypto-Assets Regulation (MiCA) is now in effect and requires CASPs to get a MiCA licence to provide their services in the EU. Several authorisations have already been issued including for some of the larger crypto companies. AMLA expects that the number of licenced CASPs will continue to increase considerably.

In its recently published Work Programme 2025, AMLA has announced the strategic objective to prevent ML/TF threats and to promote a level playing field across the EU, including for crypto-asset service sector. Following the risk-based approach, AMLA places a strong emphasis on CASPS providing services across the EU to implement anti-money laundering and countering the financing of terrorism (AML/CFT) standards consistently.

According to MICA and the European AML Framework the initial licensing and supervision of CASPs remain under the remit of national competent authorities (NCAs). There is a risk of diverging application of AML/CFT requirements and inconsistent controls. As part of its role in indirect supervision of the financial sector, AMLA expects licencing and supervisory authorities to ensure that CASPs have effective AML/CFT systems in place from day one of their authorisation.
By working closely with national supervisors and European authorities, AMLA will develop plans to promote high standards of AML/CFT controls to reach that goal. In parallel, AMLA’s financial intelligence pillar will reflect this priority by including crypto-asset related financial intelligence within the initial areas proposed for joint analyses, targeting cross-border typologies and emerging risks in this fast-evolving domain.

The AMLA publishes summary of the second General Board meeting | AML Package

The Authority for Anti-Money Laundering and Countering the Financing of Terrorism (AMLA) published a summary of the meeting of the General Board in FIU composition on 13 and 14 May 2025, Frankfurt, Germany. Topics where amongst others:

  • “European Commission / EBA information about the state of play of ongoing workstreams“: this includes work on the ‘non-financial sector’, that is supposed to be able to use the concepts that the EBA has developed for the financial sector [1].
  • “State of play and way forward – Building of AMLA (business, administration)” mentioned the digital tools of the AMLA [2]. The AMLA will use the website and linkedin for communication. The sections on recruitment address the role of member states and specific expertise [3], but not the importance of adequate knowledge on the non-financial sector and the specific legislation (differing from country to country) to those obliged entities.
  • In “AMLA Work Programme 2025 – Supervisory pillar” attention is paid to the differences between financial and non-financial sector [4] and to the risk assessment methodologies: “Regarding risk assessment methodologies in general, the point was made that member states were evaluated against different methodologies from FATF, MONEYVAL, and the EBA, and this represented a challenge which AMLA should help address.“

Transaction monitoring and the use of digital tools was discussed during the meeting [5].

It will be interesting to see whether the AMLA understands enough about the non-financial sector and can ensure that financial sector rules are not blindly transferred to companies that do not understand them.

Recently the AMLA published the Work Programme for 2025.

Notes

[1] “Regarding the non-financial sector, the Commission referred to the work conducted within the dedicated expert group created to work on all the Level 2 mandates (risk assessment, CDD and administrative sanctions) that the EBA has also been developing for the financial sector. The expert group is scheduled to expire in October this year.”

[2] “The IT building block addressed three types of requirements. The need for a digital workspace, based on the Cloud, was deemed completed, thanks to the support of the Commission DG DIGIT. For applications to run document management, HR and budget processes, AMLA was also expected to use European Commission tools. By the end of October, AMLA was expected to be equipped with the necessary tools to operate efficiently. Regarding IT business solutions geared to the specific needs of AMLA, mid-term and long-term reflections had been initiated. These solutions aim at equipping AMLA with automated data gathering and analytical capabilities leveraging the advanced technology, including AI. Important elements were still missing, notably the sources and exact data sets that will feed the databases, the details of the risk methodology, and, importantly, the views of the incoming Executive Board e.g. on sensitive matters such as data governance.” and “Finally, in relation to ICT, some members expected AMLA to clarify what tools it expects to use and for what purposes, since these decisions will also have a huge impact on the NCAs.”

[3] “On recruitment, the Chair recalled her motto and support to diversity in terms of gender, geographical balance, and skills (ie having not only AML experts, but also statisticians, mathematicians, macroeconomists, crypto experts, payment experts, etc…); she also mentioned that most of the recruitments will be opened to the public, with vacancies through the EU agencies channel only used exceptionally.”

[4] “A member of the Risk and Measures Team (…) emphasising the difficulty of accommodating basic concepts, that were quite familiar in the financial sector, to the non-financial industry, such as the concept of business relationship. Another challenge was to adapt the business wide risk assessment to the size of the obliged entities, without losing any substance.“. Strange that this would be the only area of concern.

[5] “Discussion: Almost all members who took the floor emphasized the importance of technology as a game changer reshaping not only the financial sector, but also the way criminals operate, as well as the way supervisors should conduct their activities. For some there was a unique opportunity for AMLA to harness its full potential. This did not mean starting from scratch as some tools already existed (for instance in terms of transaction monitoring) and one first step could be about improving the interlinking across member states. The importance taken by the simplification agenda, and the need to reach out to the private sector, were also raised.
The Chair concluded by confirming the top priority status of technology, as well as the importance of a risk-based approach (including a macro-perspective) and proportionality in AML/CFT supervision, also to ensure that private sector compliance costs are duly taken into account. She recalled that AMLA will apply better regulation principles as envisaged in the AMLA regulation, including impact analyses and public consultations that will allow to assess costs and benefits. However, she also recalled that the overall aim of the AML package is to ensure that the framework is robust, uniform and effective, and that AMLA’s work will have to find the right balance to achieve these goals.

  1. aanbieders van trustdiensten (trustkantoren), op hen is de Wtt 2018 van toepassing, wat onder meer betekent dat zij een vergunning nodig hebben en dat zij zich aan allerlei bedrijfsvoeringsvoorschriften moeten houden; op niet-naleving staan zware sancties;
  2. domicilieverleners volgens de AMLR-definitie, voor hen geldt de registratieplicht op basis van Wtt 2018 en zij kunnen op grond van die wet bij niet-naleving op dezelfde manier als trustkantoren gesanctioneerd worden (op grond van § 6.2. Wtt 2018 kunnen domicilieverleners door DNB gesanctioneerd worden);
