On 2 September the problems caused by FATCA for residents of the EU were discussed in the  Committee on Petitions (PETI) of the European Parliament, there is a video recording.

The meeting was digitally attended by two Dutch victims of FATCA. After the meeting the following letter was sent to one of them by the chair of PETI, Ms. Dolors Montserrat (translation from Dutch):

Thank you for participating in the meeting of the Committee on Petitions of 2 September, during which we examined your petition in more detail, taking into account the written and oral information you provided and the information provided by a representative of the Commission.

Following the discussion, the Commission decided not to close the examination of this petition and has taken a number of measures to find a solution to the problem raised in it. Firstly, we will ask the European Commission to provide further and updated information on new initiatives to find solutions with the new US administration.

We will contact the relevant responsible Commissioners, namely the Commissioner for Finance, the Commissioner for McGuinness and Data Protection – Commissioner Reynders, and the High Representative/Vice-President Josep Borrell, responsible for transatlantic relations.

The Committee on Petitions has also decided to refer your petition to the European Council in order to ensure that the dysfunctional effects of FATCA on EU citizens are properly put on the political agenda.

Contacts will also be made with the European Parliament’s Delegation for relations with the USA and with the EU’s Ambassador to the United States to request their intervention in order to draw the attention of the US Administration to these problems, with a view to promoting constructive work to resolve the existing problems.

As soon as the Committee on Petitions receives the information you have requested, the examination of your petition will continue.

Wij zullen contact opnemen met de relevante verantwoordelijke Commissarissen, namelijk de Commissaris voor Financiën, de Commissaris McGuinness en Gegevensbescherming – de Commissaris Reynders, en met de Hoge Vertegenwoordiger/vicevoorzitter Josep Borrell, verantwoordelijk voor de transatlantische betrekkingen.

De Commissie Verzoekschriften heeft ook besloten uw verzoekschrift door te verwijzen naar de Europese Raad om ervoor te zorgen dat de disfunctionele effecten van FATCA op EU-burgers naar behoren op de politieke agenda worden geplaatst.

Er zullen ook contacten worden gelegd met de Delegatie van het Europees Parlement voor de betrekkingen met de VS en met de ambassadeur van de Europese Unie bij de Verenigde Staten om hun interventie te verzoeken de aandacht van de Amerikaanse regering op deze problemen te vestigen, teneinde constructief werk te bevorderen om de bestaande problemen op te lossen.

Zodra de Commissie Verzoekschriften de gevraagde informatie heeft ontvangen, zal de behandeling van uw verzoekschrift worden voortgezet.

Ik zal u uiteraard op de hoogte houden van de stappen die verder worden ondernomen.
